JDG Associates recognizes that LOAs establish the scope of every EEO investigation. Our writers carefully review and analyze the EEO Counselor’s Report and the Formal Complaint to identify all claims/bases, frame the claims clearly and concisely, and determine whether acceptance, partial dismissal, or a full procedural dismissal is appropriate. If a claim or the entire complaint is dismissed, a thorough analysis, based on relevant case law, will be included to provide solid legal justification for the dismissal.
JDG Associates understands the importance of reaching resolution at the earliest stage of the EEO process. Our Counselors are experienced in opening lines of communication between parties, identifying resolution options, and drafting settlement agreements. If resolution cannot be reached, our Counselors will conduct a limited inquiry and draft a thorough report that documents the provided counseling and attempted resolution efforts.
JDG Associates promotes healthy communication between parties and works to reduce workplace conflict. Our experienced Mediators facilitate open, honest conversations while maintaining confidentiality in an effort to resolve the issue. Settlement agreements are carefully drafted to the mutual agreement of all parties.
JDG Associates has a national network of staff and contract EEO investigators. Our investigators all have vast experience in researching allegations of discrimination and/or harassment with a clear understanding of applicable EEO laws and regulations (Title VII, ADEA, Rehab, ADA, EPA) and have investigated individual claims, as well as more complex cases, such as continuing violations. Our reports are clearly written and comprehensive, reflecting all gathered evidence, and provide a basis for a determination and/or Final Agency Decision (FAD).
JDG Associates drafts FADs based on the merits of each individual case. Our FADs utilize applicable case law and the appropriate theory of discrimination and include a thorough analysis of each claim. Our FADs include a procedural chronology, factual background, applicable law, analysis and findings, and reach a conclusion as to whether discrimination occurred.
JDG Associates recognizes that not all complaints are investigated through the EEO complaint process and that sometimes an administrative inquiry or misconduct investigation may be more appropriate based on the specific circumstances of the allegations. These types of investigations may focus on allegations of general misconduct, to include non-EEO based harassment, or may focus on allegations of abuse, mismanagement, or fraud. JDG Associates will conduct a thorough inquiry, draft a concise report based on collected evidence, and may draft appropriate recommendations, as needed, to assist clients in addressing the misconduct.
